The Homestead Exemptions protect the equity in your home. It prevents a creditor from selling your home if the value of the home is less than the amount of the Homestead Exemption plus the amount of any loan you have taken on the Home. These exemptions were amended in 2021 under Amendment (AB 1885).  It increased the maximum amount of exemption from $175,000 to a minimum of $300,000 with a maximum of $600,000, or the amount of the median sale price for a single-family home in Riverside County, California if it does not exceed $600,000. The median sale price for a single-family residence in Riverside County is approximately $599,000.

This means that if you have a home worth $400,000 with an existing mortgage of $100,000, the creditor would have to sell your home for an amount in excess of $699,000.  The result of the amendment to the Homestead Exemption has practically protected all homes from creditors and allowed most residences to be exempt.

These issues are complex and can be confusing for many. You must be careful and have your case fully analyzed before filing bankruptcy to make certain there are not other issues. For example: the exemptions cannot be used unless you have owned and lived in your home for at least 1,215 days (approximately 3 years and 4 months) before filing for bankruptcy.
